Terms of Service
Draft for the foundation pass. Not yet reviewed by counsel. Do not treat as final before launch.
1. What Basement13 is
Basement13 acts solely as a technical host connecting players for peer-to-peer challenges. We do not create, endorse, or verify any challenge, proof, or verdict. Those are entirely between the participants.
2. Eligibility
You must be at least 13 years old to create an account. If you are under 18, you confirm you have a parent or guardian’s awareness of your use of the platform, including that challenges may involve physical activity and that XP carries no real-world value (see §6). Basement13 may request age-bracket self-certification at signup and may suspend an account it reasonably believes was created in violation of this section.
3. User-generated content indemnity
You are solely responsible for any video, prompt, or reaction you upload. By publishing content you represent that you have the right to do so and agree to indemnify and hold Basement13 harmless against any claims, damages, losses, or expenses (including reasonable legal fees) arising from that content or from your violation of these Terms.
4. Physical and mental risk
Challenges may involve physical exertion or mental strain. You participate entirely at your own risk. Assess your own fitness and limits before accepting or issuing any challenge, and never attempt anything dangerous to satisfy a prompt. To the fullest extent permitted by law, you release Basement13 from any claim, injury, or loss arising from your participation in or your opponent’s conduct during a challenge — Basement13 is not a party to the challenge itself and exercises no control over what either participant actually does.
5. Limitation of liability
The service is provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, Basement13 is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, XP standing, or goodwill, arising out of or related to your use of the service. Where liability cannot be excluded, it is limited to the greatest extent the law allows.
6. XP is not currency
XP is a non-monetary, virtual scoring metric. It has no cash value, cannot be purchased, transferred, or redeemed for real currency, goods, or services, and exists solely to track standing within the game.
7. Right to suspend or terminate
Basement13 may suspend, ban, or remove any account or content, at its sole discretion and without prior notice, for violating these Terms or the Code of Conduct, for suspected fraud or abuse, or for any reason it believes necessary to protect the platform or its users. XP and match history are not refundable or restorable following a ban.
8. Account deletion
You may permanently delete your account at any time from your profile. Deletion anonymizes your email, handle, name, and age bracket, and immediately purges any of your uploaded video proofs. It does not remove match records or XP history that other players’ own history depends on — those stay intact, disassociated from any personal information of yours. This action is irreversible.
9. Anti-capture measures
Video feeds carry a moving watermark and DOM-level restrictions intended to deter casual screen capture. These measures deter; they do not and cannot prevent OS-level screen recording.
